- it was introduced in 1985 during Rajiv Gandhi government by 52nd Amendment act. It states that a legislature is deemed to have detected if he either voluntarily gives up the membership of his party or disobeys the direction of the party leadership on a vote.
- 91st Amendment Act of 2003 states that a party to merge into another party provided at least two-thirds of its legislatures are in favour of merger complies with the law.
- Decision of defection will made by the presiding officer of the concern legislature. And it is subject to judicial review.
- it applies to both parliament and state assemblies.
